Terms of Service
Last updated: February 16, 2026
These are the rules for using OfficialObituary.com. We've written them in plain language because we believe you should be able to understand the terms you're agreeing to.
The basics
OfficialObituary.com is a free service for creating, publishing, and finding obituaries and memorial pages. You can use it without paying anything and without creating an account for most features.
By using the site, you agree to these terms. If you don't agree, please don't use the site.
What you can do
- Create obituaries and memorial pages for free
- Use our AI obituary writer to generate drafts
- Search for and read published obituaries
- Leave condolences on memorial pages
- Copy, edit, and republish obituaries you've created (the content is yours)
- Use our guides and templates for any purpose
What you can't do
- Don't post fake obituaries. Every obituary published on this site should be for a real person who has actually died. Posting fake death notices is harmful and may be illegal.
- Don't post spam. This includes obituaries created solely for advertising, SEO manipulation, or any purpose other than genuinely memorializing someone.
- Don't harass anyone. Condolence messages and guestbook entries should be respectful. Disagreements with the family's choices are not your business to air publicly.
- Don't impersonate. Don't pretend to be a family member or authorized person when you're not. Only people authorized by the family should create or edit an obituary.
- Don't use the site for anything illegal. This should go without saying, but here it is in writing.
Your content
You own what you create. The obituary text, photos, and other content you publish on OfficialObituary.com belong to you. By publishing on our site, you give us permission to display, store, and distribute that content as part of the service — but you retain ownership.
You can edit or delete your content at any time. If you want something removed and can't do it yourself, contact us and we'll handle it.
You're responsible for the accuracy of what you publish. We don't fact-check obituaries — we trust that families are providing truthful information about their loved ones.
Our right to remove content
We can remove obituaries or other content that:
- Is fake, fraudulent, or for a person who hasn't died
- Contains spam, advertising, or malicious links
- Is harassing, defamatory, or abusive
- Violates any law
- Is reported by the deceased's family as unauthorized
We'll try to contact you before removing content, but we reserve the right to remove it immediately if it's clearly in violation. If you believe content was removed in error, contact us and we'll review it.
The AI obituary writer
Our AI tool generates obituary drafts based on the information you provide. The output is a starting point — you should review and edit it before publishing. We do our best to make the AI produce appropriate, respectful content, but you're ultimately responsible for what you publish under your name.
The AI doesn't store or share the personal information you enter beyond what's needed to generate and save your obituary.
Availability
We aim to keep the site available 24/7, but we can't guarantee it. Servers go down, updates happen, and sometimes things break. We're not liable for any inconvenience caused by downtime.
Limitation of liability
OfficialObituary.com is provided "as is." We do our best to make it reliable and useful, but we can't guarantee it will be error-free or meet every need. We're not liable for any damages arising from your use of the service, including errors in published obituaries, lost content, or service interruptions.
In plain language: we'll do our best, but we're a small team building a free tool, and sometimes things go wrong. We'll fix issues as quickly as we can.
Changes to these terms
We may update these terms from time to time. If we make significant changes, we'll update this page and the date at the top. Continued use of the site after changes means you accept the new terms.
